  1. ABOUT THESE TERMS AND CONDITIONS
  1. The website and the Reserve and Collect service are provided by DUFRY TOULOUSE SAS, a simplified joint-stock company with a capital of 37,000 Euros, registered in the Commercial Register of Toulouse under number 513 943 845, with its registered office located at Toulouse Airport – Blagnac, 31700, Blagnac, France.
  2. When referring to the user of the website and/or the Reserve and Collect service, we use "you" or "your."
  3. These are the terms and conditions that apply to the use of our website and the Reserve and Collect service (referred to as the "Conditions" herein). By using our website and the Reserve and Collect service, you agree to these Conditions. If you do not wish to accept these Conditions, you will not be able to use our website or our Reserve and Collect service. Please carefully read the Conditions and ensure you understand them before using the website or the Reserve and Collect service.
  4. These Conditions apply only when you use this website and the Reserve and Collect service. If you use any links on the website to access our partner sites, please be aware that each purchase made when browsing those partner sites will be subject to their own specific terms and conditions.
  5. When the following capitalized words are used in these Conditions, their definitions are provided below:
  6. "Privacy Policy" refers to our privacy policy available at toulouse.shopdutyfree.com/privacy-policy.
  7. "Products" includes all products available on our website or included in a reservation.
  8. "Reserve and Collect" is the reservation service, without an obligation to purchase, offered through our website (and presented in our boutiques or on our websites as "Reserve and Collect") that allows you to reserve Products in advance just before your flight in our boutiques at Toulouse Blagnac Airport.
  9. "Conditions" refers to these general terms and conditions and other documents referred to herein, including our Privacy Policy; and
  10. "Website" refers to our website available at the following address: shopdutyfree.com

 

If you have any questions about these Conditions or need information regarding a reservation made through the Reserve and Collect service, please contact our customer service using the contact information provided in clause 17 below.

  1. RESERVE AND COLLECT
  1. The Reserve and Collect service is available to all passengers traveling from Terminal 1 of Toulouse Blagnac Airport where our boutiques are located. You can find information about our boutiques and those offering the Reserve and Collect service on our website.
  1. Payment for reserved Products via Reserve and Collect must be made when collecting the Product from our boutique. No payment or payment information will be requested on the website. Please refer to clause 11 below for more information regarding payment.
  2. Reservations must be made at least twenty-four (24) hours before the flight departure and within one (1) month before departure. We will not accept reservations made before or after this time frame. It is also worth noting that all Products that cannot be reserved due to these time restrictions can be added to a "Wish List" for future reference.
  3. After making a reservation through our Reserve and Collect service, you will receive an email ("Confirmation Email") from us to acknowledge your request and provide you with a reservation number. This number should be included in all correspondence related to your request. Please note that this is only confirmation of your request and does not constitute acceptance. Acceptance of your reservation will be notified in accordance with the procedure specified in clause 2.5.
  4. Within seven (7) days following the Confirmation Email, you will receive another email from us ("Reservation Email") informing you if the requested Product is available or out of stock and if it has been reserved. The Reservation Email will also include the date by which you must pay for the Product to collect it, as well as the collection point.
  5. When using the Reserve and Collect service, please ensure that all requested information has been correctly provided before submitting your request. During the reservation process, you will be asked to provide us with the time, date, departure airport, flight destination, and optionally your flight number. Please make sure that the information entered is accurate, as it will determine the date and time of Product collection. If you realize, after submitting your request and before receiving our Reservation Email, that you provided incorrect information or wish to modify your reservation, you can do so through our website by logging into your private account (if you have previously set a password to access your account during the reservation). If you realize that you have provided incorrect information or wish to modify your reservation after receiving the Reservation Email, please cancel your reservation and make a new one. Otherwise, please contact our customer service, the contact information for which is provided in clause 17, as soon as possible.
  6. Please note that neither the Confirmation Email nor the Reservation Emails constitute a binding offer. By making a reservation, you are only reserving one or more Products to collect and pay for them at the time of departure, in accordance with customs requirements and boutique sales conditions, among other things.
  7. You can cancel your reservation at any time, even after receiving the Reservation Email.
  8. We reserve the right to cancel your reservation in whole or in part for any reason and at any time. When we cancel a reservation, we will make every effort to notify you of this decision before your flight departure.
  9. For the avoidance of doubt, it is specified that neither the Confirmation Email nor the Reservation Email obligate you to pay the price of the Product. Likewise, our acceptance of a reservation from you does not obligate us to deliver the reserved Product, with the understanding that we will make our best efforts to ensure that any Product for which the reservation is confirmed in the Reservation Email is available in the boutique. The conclusion of the sales contract between you and us will only occur when you pay for and collect the Products in the boutique.

 

  1. PRODUCTS
  1. The images of the Products and any packaging (if applicable) on our website are provided for illustrative purposes only. While we have made every effort to display colors accurately, we cannot guarantee that the computer display accurately reflects the color of the Products and/or packaging. Products may vary slightly from these images.
  2. The packaging of the Products may differ from what is shown in the images on our website.
  3. All Products featured on our website are subject to availability and any duty-free restrictions (see section 7). Information about Product availability will be provided to you no later than when you visit our boutique; however, we will make our best efforts to inform you in advance through the Reservation Email if the Products you have reserved are unavailable.
  4. The range of Products offered on our website and in our boutiques (including any Products confirmed as reserved) may be subject to change without prior notice, and we reserve the right to withdraw or discontinue the availability of one or all of the Products on our website.

 

  1. PRICES
  1. We will take all necessary precautions to ensure that the prices of the Products are correct and up-to-date. However, if we find an error in the price of the Products you have reserved, please refer to clause 4.2.
  2. Our website contains a large number of Products. It is always possible that, despite our efforts, some Products on our website may have an incorrect price. If we discover an error in the price of the Products you have reserved, we will try to inform you in writing and give you the option to confirm the reservation of the Products at the correct price or cancel your reservation. We will not reserve the Products until we have your instructions. If we cannot reach you using the contact information provided during the reservation, we will treat the reservation as canceled. In no case will we be required to provide the Products at an incorrect (lower) price.
  3. Please note that if the pricing error is obvious and could reasonably have been recognized by you as a pricing error, we will not be able to provide you with the Products at an (lower) incorrect price.
  4. We reserve the right to make changes to the prices of the Products from time to time, but these changes will not apply to reservations that have been correctly made and confirmed by a Reservation Email, except for price changes due to incorrect pricing as specified in clause 4.2.
  5. The price of the Product reserved through the Reserve and Collect service guarantees you the best offer available at the time of purchase in our boutiques. If, when you collect the Products in the boutique, they are subject to a promotional offer or discount, you will be charged the lower of the two:

(a) promotional offer price or post-discount price; or

(b) price stated in your Reservation Email.

  • This applies only to Products that have been reserved and does not apply to Products added to the shopping cart in the airport boutique.
  • SECURITY
  • You are fully responsible for the use and confidentiality of any username, email verification, and password provided to you or chosen by you for use on the website. You may not share or transfer them to third parties. You must immediately notify us of any unauthorized use of these credentials or any other security breach related to the website that comes to your attention.

    1. CHANGES TO TERMS AND CONDITIONS
    1. We reserve the right to modify these Conditions from time to time. These changes will take effect when posted on our website. Notwithstanding the above, any change to these Conditions will be notified to you and must be expressly accepted by you.
    2. Each time you make a reservation with us, the Conditions in effect at that time will apply to the contract between us.
    3. Your use of our website signifies your agreement to be bound by these Conditions.

     

    1. PRODUCT AVAILABILITY AT TIME OF COLLECTION
    1. Your reservation will be automatically canceled, and the Products will be returned to the boutique for regular sale if, for any reason, you do not pay for and collect the Products within 24 hours of the date and time of collection indicated in your Reservation Email.
    2. To ensure the availability of Products in boutiques that are subject to promotional offers, there may be restrictions on the quantity of certain promotional Products you can reserve. If such a restriction applies, it will generally be indicated on the website, and you will not be able to reserve more than the allowed number of Products.
    3. Product availability may vary between boutiques, and details of available reservation Products (when the Reserve and Collect service is available) are provided on the website.
    4. When you pay for and collect the Products, we reserve the right to limit the quantity of a particular Product we sell to you or to cancel your reservation if the Products are not available at the time of collection.
    5. We will not be responsible if the Products you have reserved are unavailable or cannot be purchased on the date of your collection.
    6. Products will be your responsibility once you have collected them, and we have received full payment.

     

    1. RESTRICTIONS
    1. Some of our Products may require a minimum age for purchase (e.g., those containing alcohol), and by reserving one of these products, you confirm that you meet the required age. We are not legally allowed to provide these Products to you if you do not meet the age requirements. If you are a minor, do not attempt to reserve these Products. You or anyone you designate may be required to provide proof of your age when you pay for and collect the Products in the boutique.
    2. All reservations are subject to applicable customs regulations and/or duty-free regulations. Compliance with customs regulations is your responsibility. If you reserve Products that exceed the applicable customs regulations, we may advise you (but have no obligation to advise you) to purchase only the quantity of Products within the limits set by the applicable customs regulations. We will not be responsible for the purchase of a quantity of Products that exceeds the regulations in force.
    3. A valid boarding pass must be presented when you collect and pay for the Products, or your reservation will be canceled, and you will not be able to purchase the Products. We reserve the right to refuse the purchase of Products that cannot be transported to the destination indicated on the boarding pass, but we have no obligation to do so, and we will not be responsible if you purchase Products that cannot be transported with you to the destination indicated on your boarding pass.
    4. If, for any reason, you cannot clear airport security in the departure area, we will not be able to maintain your reservation, and it will be canceled.
    5. Please note that due to customs regulations, we are not able to deliver uncollected Products to an address outside the concerned airport boutique, and Products can only be collected at the designated collection point at that airport, as specified in the Reservation Email.

     

    1. If the products are faulty

    We inform you that you benefit from the legal warranty of conformity mentioned in articles L. 217-4 to L. 217-12 of the Consumer Code, as well as the warranty against defects in the item sold, under the conditions provided for in articles 1641 to 1648 and 2232 of the Civil Code.

    Indeed, you have a legal warranty of conformity for the ordered items, valid for a duration of two (2) years from the date of delivery of the item.

    The following situations fall under the legal warranty of conformity:

    The ordered item is unsuitable for the normal use expected of a similar item.

    The ordered item does not correspond to the description given, even if it functions perfectly.

    The ordered item does not possess the qualities described on the website.

    You also have a legal warranty against hidden defects, valid for a duration of two (2) years from the discovery of the defect. The legal warranty against hidden defects covers all expenses resulting from these defects. We are not responsible for defects that we could not have been aware of or that you have convinced yourself of. We do not guarantee defects that occur due to the use or exposure of the purchased item.

    We do not provide any other warranties on the items sold.

    To benefit from the legal warranties, we invite you to contact customer service, the contact details of which are provided in clause 17.

    Legal Warranty of Conformity (Art. L. 217-4 and following of the Consumer Code)

    Article L. 217-4 of the Consumer Code:

    "The seller delivers a product in conformity with the contract and is liable for conformity defects that exist at the time of delivery.

    He is also liable for any non-conformity resulting from the packaging, assembly instructions, or installation when it was his responsibility under the contract or was carried out under his responsibility."

    Article L. 217-5 of the Consumer Code:

    "The product is in conformity with the contract if:

    1° It is suitable for the use usually expected of a similar product, and, where applicable:

    It corresponds to the description given by the seller and possesses the qualities that the seller presented to the buyer in the form of a sample or model;

    It has the qualities that a buyer can legitimately expect in light of public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;

    2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the seller's attention and accepted by the latter."

    Article L. 217-12 of the Consumer Code:

    "Action resulting from a conformity defect is time-barred after two years from the delivery of the product."

    Article L. 217-16 of the Consumer Code:

    "When the buyer requests the seller, during the course of the commercial warranty granted at the time of acquiring or repairing a movable item, a repair covered by the warranty, any period of immobilization of at least seven days is added to the remaining warranty period.

    This period runs from the buyer's request for intervention or the availability for repair of the item in question, if this availability is subsequent to the request for intervention."

    Warranty for Defects in the Item Sold (Art. 1641 and following of the Civil Code)

    Article 1641 of the Civil Code:

    "The seller is bound by the warranty for hidden defects of the item sold that render it unfit for the use for which it was intended, or that diminish this use to the extent that the buyer would not have acquired it, or would have given a lower price for it, had they known."

    Article 1648, paragraph 1, of the Civil Code:

    "Action resulting from redhibitory defects must be brought by the buyer within two years from the discovery of the defect.”

     

    1. RETURNS
    1. If you are dissatisfied with the products for any reason, you can return them to us within sixty (60) days. If you wish to return a product, shipping costs will be at your expense.

     

    1. PAYMENT
    1. You are not obligated to purchase the products you have reserved using the Reserve and Collect service. If you change your mind when you come to pay and collect the products, you can choose to replace the products with other items currently available in the store. You will pay the in-store price for these items. If you no longer wish to purchase the products, you can cancel your order via the website before your departure date or by informing a staff member in the store.
    2. We accept payment in various currencies in-store. If you wish to pay with a currency other than Euros (EUR), the currency conversion rate you wish to use will be determined in accordance with our in-store sales terms on the date of purchase.

     

    1. LIMITATIONS ON WARRANTIES AND LIABILITY
    1. Subject to clause 12.4, we will make reasonable efforts to verify the accuracy of any information on the website, but make no express or implied representations or warranties, statutory or otherwise, regarding the content or availability of the website, whether defects will be corrected, or that the website or the server making it available are free of viruses or bugs, or represent the complete functionality, accuracy, or reliability of the website. We will not be liable to you for any loss of content or material downloaded or transmitted through the website, and we accept no responsibility for any kind of loss or damage resulting from actions taken on the material or information contained on the website.
    2. In case of our breach of these Terms, we shall be liable only for direct losses or damages caused to you during your use of the website. Loss or damage is foreseeable if it is an obvious consequence of our breach of these Terms. To the extent permitted by applicable law, we shall not be liable for any other damages of any kind, including indirect, special, consequential, or incidental damages, or other damages resulting directly or indirectly from your use (or inability to use) the website or the Reserve and Collect service.
    3. We provide products only for domestic and private use. You agree not to use the product for commercial purposes or for resale, and we shall not be liable to you for loss of profits, loss of business, business interruption, or loss of business opportunity.
    4. We do not exclude or limit our liability in any way for:

    (a) death or personal injury caused by our negligence; and

    (b) fraud.

     

    1. USE OF OUR WEBSITE
    1. You are solely responsible for all your activities using our website and for the security of your computer systems. You are responsible for any losses and damages caused by your use of the website and the Reserve and Collect service.
    2. We reserve the right to terminate your account if you do not comply with the Terms or the laws and regulations governing the use of our website. You can modify or cancel your registration on the website at any time through the website or by contacting our customer support team using the contact information provided in clause 17 below.
    3. You must not use the website for illegal or fraudulent purposes. You must not damage or attempt to damage the website, including introducing viruses, Trojans, worms, or other technologically harmful programs. In particular, you must not access without authorization, interfere with, damage, or disrupt the website or any part of it; any equipment or network on which the website is stored; any software used in connection with the provision of the website; or any equipment, software, or website owned or used by a third party. You must not damage the website by conducting a denial-of-service attack (DoS attack).
    4. Without prejudice to our other rights and remedies, we reserve the right to take legal action against you to obtain compensation for any harm resulting from your breach of clause 13.3 and to provide any necessary information to the relevant authorities."

     

    1. FORCE MAJEURE
    1. We shall not be responsible or held liable for any failure in the performance or delay in the performance of any obligation under these Terms caused by a Force Majeure Event.
    2. Force Majeure Events are those commonly recognized by the jurisprudence of French courts and tribunals, as stipulated in Article 1218, paragraph 1, of the Civil Code, including, but not limited to, strikes, lockouts, or other industrial actions by third parties, supplier default or delay, civil unrest, riots, invasion, terrorist attack or threat of a terrorist attack, war (declared or not) or a threat or preparation for war, fire, explosion, storm, flooding, earthquakes, collapses, epidemics, or other natural disasters, or the failure of public or private telecommunications networks.
    3. If a Force Majeure Event occurs and affects the performance of our obligations under a contract entered into with you, we will notify you as soon as possible.

     

    1. RESTRICTIONS ON THE USE OF OUR WEBSITE

     

    1. Subject to clause 16 below, you may not download, copy, use, or create derivative works, especially for commercial purposes, from any exclusive information or content on our website, including, but not limited to, images, prices, or descriptions of products or trademarks, trade names, or logos. This includes any copying or derivative work created for the benefit of a third party. The use of data mining, robots, or any other data collection and/or extraction tools is strictly prohibited.

     

    1. INTELLECTUAL PROPERTY AND PROPERTY RIGHTS
    1. All intellectual property rights and other rights relating to (i) our website and its content (including images, designs, logos, videos, databases), and (ii) the trademarks, trade names, domain names, and product names used on our website, are held and expressly reserved by Dufry Toulouse, World Duty Free Group, Dufry Group, and its affiliated companies, or by the trademark owners providing the products. Any use of these rights without the express written consent of DUFRY Toulouse or the relevant trademark owners is strictly prohibited.

    1. GENERAL PROVISIONS
    1. We may, at our sole discretion, transfer our rights and obligations under these Terms to another organization.
    2. These Terms constitute the entire agreement between you and us. Any modifications to these Terms must be made in writing.
    3. Each of the clauses in these Terms is independent. If a court or competent authority determines that one of them is void or unenforceable, the remaining clauses shall remain in full force.
    4. If we do not insist on the performance of one of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay a remedy, this does not mean that we have waived our rights or that you are not obligated to fulfill your obligations. Any waiver of one of our rights or a remedy under these Terms is valid only if made in writing, and does not mean that we will waive any other right or remedy.
    5. These Terms are governed by the laws applicable in France. To the extent permitted by law, any dispute concerning these Terms, Reserve and Collect, or your use of the website shall be resolved in the courts of Toulouse.
    6. In accordance with Articles L.611-1 and following of the Consumer Code, it is provided that for any contractual dispute that has not been resolved through a prior complaint made to our customer service, you, as a consumer, may seek free mediation by contacting a consumer mediator listed on the following website: www.economie.gouv.fr/mediation-conso."
